Consultancy to Conduct an Assessment on the implementation of Prevention and Suppression of Human Trafficking and Migrant Smuggling Proclamation No. 909/2015, Federal Administrative Procedure Proclamation No. 1183/2020, and Ethiopian Civil Society Proclamation No 1113/2019, and Conduct a capacity building Training for HoPR and Regional State Councils  

Background

The works of Human Rights focused civil society organizations (CSOs) suffered as direct targets of much domineering legislative, institutional and political measures taken by the government for the past many years, especially before 2018 in Ethiopia. With the vision of creating a platform for strong and vibrant human rights CSOs for the realization of human rights and democratic values in Ethiopia, an engagement with Human Rights CSOs started in 2015and Consortium of Ethiopian Human Rights Organizations (CEHRO) was registered on the 16th of March 2018 (re-registered as per 1113/2019 with registration number 3932). Currently, CEHRO has 17 active CSO members from regions of the country. From its establishment, CEHRO is determined and working to the advancement of human rights protection in Ethiopia by creating a common platform for human rights CSOs to articulate their voices and launch well-articulated and evidence based advocacy to expand the space for human rights CSOs and continue engagement with stakeholders as well as building the capacity of both the old and new human rights CSOs, to ensure effective human rights and democratic governance works.

In addition, CEHRO believes any reform should be supported by knowledge and learning of reform implementations, identifying gaps and recommendations for improvements. Accordingly, CEHRO plan to conduct an assessment on the implementation of three recent law reforms relevant to human rights and justice sector reforms, the analysis of which includes the developments made in the implementations, identifying any failures, what is needed to enhance the effectiveness, and making recommendations for restructuring efforts, expanding stakeholders, such as involving CSOs, and academicians in the improvement efforts. The assessment focuses on the proper implementation of the Prevention and Suppression of Human Trafficking and Migrant Smuggling Proclamation No. 909/2015Federal Administrative Procedure Proclamation No. 1183/2020, and Ethiopian Civil Society Proclamation No 1113/2019, as well as the roles of the parliament, civil society organizations, and other relevant stakeholders in ensuring their implementation.

The consultants will be responsible to conduct an assessment that will look at the role of standing committees, civil society organizations, and other interested rule of law stakeholders in realizing the implementation of these legal reforms, as well as the ratification and proper application of international instruments ratified by Ethiopia in light of best practices in other countries. In addition, the consultant will be responsible for conducting two rounds of three-day training on Human Rights Based Approach (HRBA) and implementation of the three legal reforms listed for a total of 42 members of the HoPR’s standing committees, members of the two regional state councils, and members of the two City Administration councils. The training will be based on the legal assessment findings.

Objectives of the Consultancy Service

CEHRO intends to assess how the Prevention and Suppression of Human Trafficking and Migrant Smuggling Proclamation No. 909/2015, Federal Administrative Procedure Proclamation No. 1183/2020, and Ethiopian Civil Society Proclamation No 1113/2019 are relevant to human rights and judicial reform, and to produce reports for future improvements.

Specific Objectives of the assessment:

  • To assess, analyze and developments made in the implementations of these three law reforms;
  • To assess, the roles of the parliament, CSOs, and other relevant stakeholders in ensuring the implementation of these laws;
  • To identify any failures, gaps in the implementation and make sound recommendation for restructuring efforts, expanding stakeholders, such as involving CSOs, and academicians in the improvement efforts;
  • To use the findings and recommendation of the assessment as a baseline on which the capacity building training for the standing committees and regional council spokesperson will depend on and will be an input to let them understand in what areas their attention and immediate action is needed.

Scope of work

As a key component, CEHRO intends the scope of work for this consultancy services to focus on the following:-

  • The consultant will conduct an assessment of the three legal reforms implementation listed in the above; The assessment will consider the following among others:
    • Any developments made in the implementation of these laws vis a vis  their performance so far;
    • Assess the role of the oversight power of parliaments in ensuring the proper implementation ;
    • Identify any failures on the implementation of the laws;
    • Conduct a capacity building training for the standing committee and regional state councils based on the findings of the assessment.
  • The consultants will make an analysis of the experience of other countries in similar context as comparative analysis.
  • The consultant will review ratification and proper application of issue related international instruments ratified by Ethiopia in light of the very objectives and provisions of the laws and best practices in other countries
  • The consultant will develop document on a devising strategies for the parliament to ensure the effective implementation of such reforms
  • Perform other tasks as required to achieve the objectives of the scope of work.

Methodology

  • The consultant is expected to propose a comprehensive and effective methodology to produce high quality, comprehensive and practical deliverables.

Expected Deliverables

  • Submission of a draft report
  • Submission of comprehensive report on the assessment of each of the laws identifying all the gaps observed with a recommendation;
  • Develop- training manual based on the assessment for the capacity building training of the standing committees and regional council spokesperson ;
  • Presentation of the findings of the assessment to parliament standing committees and the regional council spokespersons; and
  • Submission of final report based on review of the draft report by CEHRO, Feteh activity and outputs from the presentation workshop

 Timeline and number of days

CEHRO anticipates the consultant to complete this assignment within one (4) month. The starting date will be the signing of the consultancy agreement.

Job Requirements

Qualifications for consultant

  • LLB/LLM/in Law and minimum 5/8 years of experience in researching, analysis, reviewing projects relating to Human rights, legal and justice reforms in Ethiopia.
  • Relevant experience and engaged as members of the Legal and Justice Affairs Advisory Committee (LJAAC)
  • Experience and exposure around the legal reform, justice reform or CSOs leaders and practitioner who been advocating for the legal and institutional reforms in Ethiopia.
  • Excellent knowledge and understanding of legal, socio-economic, political and cultural context of the parliament in Ethiopia.
  • Excellent knowledge of the three laws through drafting, participation in the consultations for input collection, application, and/or through organizing or being discussant on law reform and review workshops. ( exposure to the drafting of the laws
  • Excellent written and spoken skills in Amharic and English.
  • Excellent research, analytical and communication skills.
  • Knowledge and deep understanding of Human Rights, Ethiopian legal system and its sector.
  • Having knowledge of and/or proven expertise in participatory approaches in conducting assessments
